Stack-OH! Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Calendee LLC (“Calendee,” “we,” “us”), the maker of Stack-OH! (the “Service”). By using Stack-OH!, you agree to these Terms. If you don’t agree, please don’t use Stack-OH!

1. Who can use Stack-OH!

You must be at least 13 years old. By using Stack-OH!, you confirm you’re 13 or older and able to enter into this agreement.

2. Your account

You’re responsible for activity under your account and for keeping your sign-in method secure. Don’t impersonate others or use a display name that’s offensive, infringing, or misleading. We may suspend or terminate accounts that violate these Terms.

3. Acceptable use

Don’t: cheat, exploit bugs, or interfere with fair play; harass, abuse, or threaten other players; upload unlawful, infringing, or offensive content (including display names); disrupt, reverse-engineer, scrape, or gain unauthorized access to the Service; or use it for any illegal purpose. We may remove content and suspend access to keep Stack-OH! safe and fair.

4. Purchases, plays, and Pro

Stack-OH! offers optional in-app purchases, including consumable “plays” packs and a one-time Pro upgrade.

• All purchases are processed by Apple (App Store) or Google (Google Play). We never receive your payment-card information.
• All sales are final. Refunds, where available, are handled by Apple or Google under their policies — request them through the store you bought from.
• Consumable plays are non-refundable once used. Plays and virtual items have no cash value, can’t be exchanged for money, and can’t be transferred.
• We may change the price, availability, or contents of purchases and of any free-play allowance at any time, but changes won’t affect items you’ve already bought.

5. Intellectual property

Stack-OH! — including its software, design, graphics, and content — is owned by Calendee LLC and protected by law. We grant you a personal, non-exclusive, non-transferable, revocable license to use Stack-OH! for your own enjoyment, subject to these Terms.

Stack-OH! is an independent game inspired by the classic number-sequencing card game RACK-O®. Stack-OH! is not affiliated with, endorsed by, sponsored by, or associated with RACK-O or any current or former owner of the RACK-O name, trademark, or intellectual property. “RACK-O” is a trademark of its respective owner and is used here only to describe the kind of game Stack-OH! is.

6. Service changes & availability

We’re always improving Stack-OH!, so features may change and the Service may occasionally be unavailable. We may modify, suspend, or discontinue all or part of the Service at any time.

7. Disclaimers

Stack-OH! is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant the Service will be uninterrupted, error-free, or secure.

8. Limitation of liability

To the fullest extent permitted by law, Calendee LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from or relating to your use of Stack-OH! Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) US $50.

9. Resolving disputes

• Talk to us first. Before filing any legal claim, email info@stackoh.com and give us 30 days to try to resolve it informally.
• Class-action waiver. To the fullest extent permitted by law, you and Calendee agree to bring claims against each other only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative action.

10. Governing law & venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute not resolved informally will be brought exclusively in the state or federal courts located in Collin County, Texas, and you consent to their jurisdiction.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we’ll update the “Last updated” date and, where appropriate, notify you in the app. Continued use after changes means you accept the updated Terms.
